Heritage Built. Future Ready.
At Habicon, we understand that building your dream home is one of the most significant decisions you'll make. Just as we're committed to building homes with integrity and transparency, we're equally committed to protecting your personal information and respecting your privacy.
This Privacy Policy explains how Habicon, LLC ("Habicon," "we," "us," or "our") collects, uses, discloses, and safeguards your information when you visit habicon.com, submit a form, use our services, or communicate with us by email, phone, or text message throughout your homebuilding journey.
When you engage with Habicon, you may provide us with personal information, including:
When you visit our website, we may automatically collect:
We use cookies, pixels, tags, and similar technologies to operate the site, remember your preferences, analyze site usage, and measure our advertising. You can control cookie preferences through your browser settings. See "Your Privacy Rights and Choices" below for opt-out options.
We do not collect income details, credit information, or credit reports through this website. We do not purchase, rent, or receive consumer contact lists from lead sellers, lead aggregators, or data brokers, and we do not send text messages to numbers obtained from any such source.
We use the information we collect to provide you with exceptional service throughout your homebuilding journey:
Additional Uses:
We collect text-messaging consent through a form on habicon.com that presents separate, unchecked consent checkboxes: one for transactional and informational messages, and one for promotional and marketing messages. You may check one, both, or neither.
Consenting to receive text messages is never required to submit a form, to receive information, or to purchase any product or service. Providing your phone number alone is not consent to receive text messages, and accepting our Terms and Conditions or this Privacy Policy does not enroll you in text messaging. We send only the categories of messages you affirmatively agreed to receive.
When you consent, you agree to receive recurring automated text messages from Habicon, LLC at the number you provided. Each consent applies only to the Habicon messaging program described below. We do not operate shared, co-branded, or co-registered opt-in forms, and we do not collect consent on behalf of any other business.
| Program | Habicon, LLC customer messaging |
|---|---|
| Transactional and informational messages | Consultation and appointment confirmations and reminders, project and build status updates, lot and design process updates, account and service notices, and replies from our team to questions you submit |
| Promotional and marketing messages | New floor plan releases, lot and community availability, events, and special offers |
| Message frequency | Varies based on your interaction with us. Approximately four messages per month or fewer. |
| Cost | Message and data rates may apply, according to your mobile carrier plan. We do not charge a separate fee for the messaging program. |
| To opt out | Reply STOP to any message |
| For help | Reply HELP, email privacy@habicon.com, or call 801-381-2416 |
You may opt out at any time by replying STOP to any message. After you send STOP, we will send one confirmation message and will not send further texts unless you opt in again. You may opt out of marketing messages while continuing to receive transactional messages by contacting us at privacy@habicon.com. Carriers are not liable for delayed or undelivered messages.
Real estate professionals, architects, designers, contractors, suppliers, and other partners we work with do not receive your mobile phone number or your text-messaging consent from us, and they do not send you text messages using consent you provided to Habicon, LLC. If you want to receive text messages from a partner, you must provide consent to that partner directly.
Habicon values your trust and carefully limits how we share your information. We do not sell your personal information for money. We do not sell, rent, or provide your information to lead buyers, lead aggregators, data brokers, or marketing partners. We never sell or share your phone number, mobile information, or text-messaging consent and opt-in data.
We work with vendors that perform services on our behalf, including website hosting, customer relationship management and messaging, payment processing, email delivery, and analytics. These providers may access information only to perform services for us and are bound by confidentiality obligations. Any mobile numbers or opt-in data shared with such subcontractors is limited to operating, delivering, and technically supporting our messaging program and is not used for their own marketing.
Delivering a home requires coordination with independent professionals. Where you ask us to connect you with a real estate professional, architect, designer, contractor, or supplier, we will identify that party to you and share only the project information necessary for them to perform the work you requested, together with the contact details you designate for that purpose. We do not share your mobile phone number, text-messaging consent, or opt-in data with these parties. These are independent businesses, and their use of information you provide them directly is governed by their own privacy practices.
We may disclose your information when required by law, in response to legal process, to protect our rights, or to ensure the safety of our customers and employees.
In the event of a merger, acquisition, financing, or sale of assets, your information may be transferred to the acquiring entity, subject to this Policy.
Although we do not sell personal information for money and never share your phone number or text-messaging consent data, our use of advertising and analytics cookies and pixels may involve disclosing online identifiers, device information, and browsing activity to advertising partners such as Meta and Google. Under some state privacy laws, this activity may be considered a "sale" or "sharing" of personal information or "targeted advertising." You can opt out as described below.
Just as we build homes to last for generations, we implement robust security measures to protect your information:
While we strive to protect your information using industry-standard practices, no method of transmission or storage is 100% secure. We encourage you to take steps to protect your personal information, such as using strong passwords and keeping your login credentials confidential.
You have important rights regarding your personal information:
You may request access to the personal information we hold about you and request corrections to inaccurate information.
Reply STOP to any message to opt out at any time, as described above.
You can opt out of marketing emails by clicking the "unsubscribe" link in any promotional email or by contacting us directly. Please note that you may still receive transactional or service-related communications about your project.
You can manage cookie settings through your browser preferences. Disabling cookies may affect your ability to use certain features of our website. You can also manage interest-based advertising choices through the Digital Advertising Alliance at optout.aboutads.info, the Network Advertising Initiative at optout.networkadvertising.org, and through your Meta and Google ad settings.
Because there is no common industry standard for recognizing "Do Not Track" browser signals, we do not currently respond to them. Where required by law, we honor recognized browser-based opt-out preference signals, such as the Global Privacy Control (GPC), as a request to opt out of the "sale" or "sharing" of personal information and targeted advertising for the browser or device from which we receive the signal.
You may request deletion of your personal information, subject to legal and contractual retention requirements.
Depending on where you live, you may have additional rights under state privacy laws, including in California, Virginia, Colorado, Connecticut, Texas, Utah, and other states with comprehensive privacy laws. Subject to applicable law and verification, these may include the right to know what information we collect and how we use and disclose it, to request correction or deletion, to obtain a portable copy, to opt out of the "sale" or "sharing" of personal information and of targeted advertising, and not to be discriminated against for exercising your rights. Habicon, LLC does not sell personal information for money. To exercise any right, contact us using the details below. You may use an authorized agent, subject to our verification of identity and authority. If we decline your request, you may appeal by contacting us at the same address, and you may contact your state attorney general with concerns about our response.
Our services are not directed to individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected information from a child, we will take steps to delete it promptly.
Our website may contain links to third-party websites, including those of our partners and service providers. We are not responsible for the privacy practices of these external sites. We encourage you to review their privacy policies before providing any personal information.
We retain your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, comply with legal obligations, resolve disputes, and enforce our agreements. Project-related information may be retained for warranty and historical purposes. Text-messaging consent and opt-out records are retained for at least four years to document your consent and to comply with applicable messaging regulations.
While Habicon primarily serves customers in the United States, if your information is transferred outside your jurisdiction, we will ensure appropriate safeguards are in place to protect your information in accordance with this Privacy Policy.
We may update this Privacy Policy periodically to reflect changes in our practices, technology, legal requirements, or other factors. We will post the updated policy on our website with a revised "Last Updated" date. For material changes, we will provide more prominent notice or obtain consent as required by law. Changes to this Policy do not alter or renew any text-messaging consent you have given or withdrawn.
We encourage you to review this Privacy Policy periodically to stay informed about how we protect your information.
